Kodiak Sky – Drone Photography & Cinematography Services
These Terms and Conditions ("Agreement") outline the terms governing all drone photography and cinematography services provided by Kodiak Sky. By booking and utilizing our services, you agree to the following terms:
1. Scope of Work
1.1 Project Details
Kodiak Sky provides professional aerial photography and cinematography. Each project will include a detailed scope of work outlining:
Type of drone service requested
Project location(s)
Payment type
Intended use of the deliverables
1.2 Preparatory Work
Clients are responsible for obtaining any required permissions, permits, or approvals from landowners, venue operators, or authorities before drone operation occurs.
If permission, permits, or approval is needed from landowners, a copy will be sent to Kodiak Sky before the date of operation.
Kodiak Sky will secure Drone approval permission when operating in Class B, C, D, E, and G airspace if needed.
Site assessments may be required before the scheduled flight.
1.3 Travel & Accommodation
Travel within Walla Walla City and College Place is not included in the service cost. Local travel is free of charge. Additional travel fees apply for locations beyond this range.
If overnight accommodation is necessary, additional charges will apply and be agreed upon before service confirmation.
1.4 Post-Production Services
Standard post-production services, including basic editing, color correction, and enhancement, are included in all the project cost.
Additional post-production requests, such as advanced visual effects, custom edits, or branding overlays, and music copyrights may be available at an extra charge.
1.5 Data Delivery
Deliverables will be provided via secure digital download links unless otherwise specified.
Hard copies, USB transfers, or other formats are available upon request.
2. Ownership and Usage Rights
2.1 Copyright
All photos, videos, and other media created by Kodiak Sky remain the intellectual property of Kodiak Sky.
The client is granted a limited, non-exclusive license for approved use but cannot resell, distribute, or modify the media without prior written consent.
2.2 Usage Rights
Clients may use the delivered media for advertising, marketing, and personal use but may not sell or use the content for unlawful purposes.
Any unauthorized use of Kodiak Sky's content may result in legal action.
2.3 Licensing Options
Clients may purchase exclusive or extended commercial licenses if additional rights are required. License terms and costs will be determined based on usage needs.
3. Liability and Insurance
3.1 Limitation of Liability
Kodiak Sky is not liable for damages or losses resulting from:
Uncontrollable circumstances, such as weather, regulatory restrictions, or airspace limitations.
Client misuse of media.
Third-party interference during drone operations.
3.2 Insurance Coverage
Kodiak Sky carries liability insurance to cover accidents or damage caused by our equipment during flights.
Clients may request proof of insurance.
3.3 Risk Acknowledgment
The client acknowledges that drone operations come with inherent risks.
Kodiak Sky follows strict safety measures to mitigate any operational risks.
4. Privacy and Permissions
4.1 Data Privacy
Kodiak Sky respects client privacy and will not share, sell, or distribute client-provided personal data without consent.
4.2 Permissions & Compliance
Clients must ensure that the drone operation is legally permitted at the event or location.
Any restrictions, venue policies, or FAA regulations affecting drone use must be disclosed before booking.
4.3 Confidentiality
Any confidential or sensitive information shared between the client and Kodiak Sky will be kept strictly confidential.
5. Cancellation and Termination
5.1 Cancellation Policy
Clients may cancel their booking with a full refund if notice is given at least 48 hours before the scheduled shoot.
Cancellations within 48 hours of the shoot may be subject to a partial refund
5.2 Weather & Safety-Related Cancellations
If unsafe weather conditions (strong winds, heavy rain, or poor visibility) prevent flights, the client may:
Reschedule at no extra cost
Receive a full refund if rescheduling is not possible.
If drone operations are canceled after arriving on location due to sudden unsafe conditions, a partial refund may be issued at Kodiak Sky’s discretion.
5.3 Termination of Services
Kodiak Sky reserves the right to terminate services immediately if:
Flight conditions are deemed unsafe.
The client violates legal drone operation policies.
The project requires work beyond the agreed scope.
6. Dispute Resolution
6.1 Resolving Disputes
In the event of a dispute, both parties agree to attempt mediation before pursuing legal action.
Mediation will take place in person or virtually if needed.
6.2 Governing Law
These Terms and Conditions are governed by the laws of Washington State
FAA Regulations - Drones (UAV) are protected by law and considered aircrafts if they are registered with the FAA
7. Agreement Acknowledgment
By booking services with Kodiak Sky, you acknowledge and agree to these Terms and Conditions. Any modifications to this agreement must be in writing and signed by both parties.
